General Terms and Conditions of Business
GENERAL TERMS AND CONDITIONS
The general terms and conditions, which are accepted by you with your booking, regulate the legal relationship between you and the Pension “Traumblick”, your landlord in Oberhof.
Please read carefully.
1. Registration / Booking
The Accommodation Agreement is concluded as soon as the room has been ordered or confirmed or – if a confirmation was not possible for reasons of time – has been made available.
2. Prices
The prices quoted correspond to the tariffs we had at the time of the tender.
We reserve the right to make changes or deviations of individual travel services from the agreed content of the contract, which become necessary after conclusion of the contract and which were not caused by us in bad faith, provided that the changes or deviations are not substantial and do not affect the overall design of the booked trip.
3. Visitor’s tax
Visitor’s tax is charged by the town of Oberhof and is not included in our prices. This will be charged and paid separately by us.
4. payments
Invoices are always to be paid on the day of departure, taking into account any advance payments. For stays of 5 nights or more, we are entitled to issue interim invoices at our discretion. In case of short term arrival and arrival after 21.00 o’clock we reserve the right to charge a prepayment. Advance payments may be required for certain types of arrangements. If the agreed advance payments are not made on the desired date (if no date is specified, at the latest 90 days before arrival), this immediately releases us from the agreements made.
5. complaints
Despite all efforts, complaints cannot be ruled out. These must be reported by you immediately, preferably in writing to the reception. Should the problem not be solved to your satisfaction after a reasonable period of time, you must make the corresponding claims for non-contractual provision of the travel service within one month after termination of the journey against the Lessor.
6. Provision / Pithdrawal
The conclusion of the accommodation contract obliges you, like us, to fulfil the contract, regardless of the duration of the contract. Reserved rooms are at your disposal from 15.00 hrs. Unless a later arrival time has been expressly agreed, we reserve the right to re-allocate unused rooms after 6 p.m. You are free to withdraw from the trip at any time. If you withdraw from the travel contract, we can demand the following compensation from you:
– up to 4 weeks before the date of arrival : cancellation free of charge
– up to 3 weeks before arrival date : 50% of the agreed travel price
– up to 2 weeks before arrival date : 80% of the agreed travel price
– by the day of arrival: 100%.
We as landlords are obliged in good faith to allocate unused rooms to other tenants if possible in order to avoid cancellations. However, you are obliged to pay the above-mentioned cancellation costs until the room is otherwise allocated.
7. Written form
Declarations of withdrawal, rebooking and changes should in your interest be made in writing in any case.
8. Pets
Pets may only be brought along after written confirmation.
Otherwise we can refuse to accept them into the boarding house.
9. Cancellation of the travel contract
If the trip is directly or specifically endangered or impaired considerably as a result of force majeure (natural disasters, war, civil unrest), we are entitled to withdraw from the contract. In such a case, any payments already made by you will be refunded in full.
10 General obligations
All guests are obliged to follow the house rules valid in the pension. Violation of the house rules may result in expulsion from the boarding house without full or partial refund of the rent.
11. Place of jurisdiction
Place of jurisdiction for both parties is Suhl.
12. Ineffectiveness of individual conditions
The invalidity of individual conditions of the travel contract does not result in the invalidity of the entire travel contract.
13. Dispute settlement proceedings
In accordance with its legal obligation, the Hotel draws attention to the fact that the European Union has set up an online platform for the out-of-court settlement of consumer disputes (“OS Platform”): ec.europa.eu/consumers/odr. However, the hotel does not take part in dispute resolution procedures before consumer arbitration bodies.
14. printing errors
Misprints do not obligate us. Translated with www.DeepL.com/Translator (free version)
